S.Korean high court bars mobile carriers from sharing public's data with authorities

Court strikes down law allowing mobile carriers to share data with law enforcement authorities without notifying affected users

ANKARA (AA) - South Korea’s Constitutional Court on Thursday struck down a law that authorized mobile carriers to share personal data with law enforcement agencies without notifying the user, local media said.

According to the Yonhap News Agency, the court struck down the law unanimously, calling it unconstitutional.

Under the Telecommunications Business Act, mobile carriers were allowed to accept requests from investigative authorities to provide them data of any customer under investigation.

However, the court ruled the law violates the right to self-determination of personal information.

The court also called the sharing of personal information without notifying the affected persons unconstitutional.

The law was challenged by number of civic groups and lawyers in the court, according to the agency.
