NEW YORK (AA) - Daniel Penny, who put Jordan Neely in a fatal chokehold on a New York City subway, was released on a $100,000 bail after his arraignment on Friday.
The Marine veteran, 24, has been charged with second-degree manslaughter in connection with the chokehold death of the homeless Black man in early May.
Penny pleaded not guilty. The judge ordered him to surrender his passport within 48 hours and not to travel outside of New York.
He will be back in court on July 17.
Neely, 30, who reportedly had mental health issues, was shouting at other subway passengers before he was pinned down by Penny.
Penny's defense lawyers argued that Neely was "threatening" other passengers on the subway, and that Penny did not intend to cause him harm.
Penny was initially released on the day of the incident after questioning by the police. However, video footage of the fatal incident surfaced and led to outrage and protests.
